Lien Unprotected

In 1970, Don obtained a Small Business Administration loan for $100,000 to finance a fishing boat business. The loan was recorded against all property owned by Don. The fishing business collapsed. Years passed. In 1986, Don went to build a home on one of his properties and discovered the SBA loan lien. Accumulated interest doubled the outstanding loan amount.

The lien had to be removed so that Don could refinance his property to build on it.

Our firm researched and learned that a change in the law required all lien holders in California to give notice of their intent to collect within a five-year period. The statute term was perfected after the first of January, 1987. Upon being served, the U. S. Government removed the case to federal court. The Government's motion for summary judgment was denied as California law took precedence. The Government failed to give notice during the five-year period of its intent to collect on the Note. The lien was removed.
