| CIVIL INSURANCE DEFENSE Major insurance carriers have retained this firm's services in defending personal injuries, property damage, and professional negligence. Herman, a psychologist, was accused of sexual misconduct with a patient. The patient sued for compensatory and punitive damages. The carrier could not represent Herman as to the issue of punitive damages. Therefore, the psychologist was entitled to counsel of his own selection. This avoided a conflict of interest for the insurance company's supplied counsel. The case was settled within the doctor's malpractice insurance limits. Herman paid nothing of his own money for either the attorney fees, costs or settlement. 2. Fred, an accountant, was sued for professional negligence. Allegedly, he had informed an attorney of a tax shelter plan. Unbeknownst to the accountant, the plan was not approved by the I.R.S. The attorney sued the accountant. Fred, having errors and omissions insurance, contacted his carrier. The carrier refused to represent or pay for representation of Fred. This firm was able to persuade the carrier to pay attorney fees for this firm's representation of Fred. Fred's rights in the action were protected and the case was eventually dismissed. And, Fred did not pay any money. Dentist Dilemma Jane, a dentist, was accused of interfering with the sale of a neighboring dental practice. Jane and her dental assistant were sued for $20 million. Through discovery, this firm learned that the opposing counsel was not admitted to practice in the State of California. When brought to the court's attention, new counsel admitted to the State Bar was retained by the plaintiff. Our firm was able to get the insurance carrier to pay the defendants' fees and costs. Ultimately the case was dismissed having failed to get past the early pleading stage. On behalf of the dentist and dental assistant, this firm sued the admitted and non admitted attorneys for malicious prosecution and intentional infliction of emotional duress. Judgments were obtained for both the dental assistant and the dentist. The dentist case was affirmed on appeal in a published opinion.
