Family Law is a most sensitive area of practice. The level of anxiety that arise between divorcing couples is one of the highest of that experienced by individuals in life. Calmness, explanation, and patience are requisites of any lawyer who practices in this area. The matters we handle include, but are not limited to:

1. Dissolution of marriage.

2. Custody and visitation for children.

3. Division of community property.

4. Confirmation of separate property.

5. Division of debts.

6. Resolution of pension and retirement plans through qualified domestic relation orders or otherwise.

Some Behavioral Tips

Following are some of the ideas we discuss with our clients:

1. Is there an acid test to determine if you're ready for divorce? Probably not. However, if you can answer yes, that there is no doubt in your mind that irreconcilable differences have led to an irremedial breakdown of the marriage, then, you may be ready for divorce. Be sure to exhaust all alternatives such as counseling. Once you reach this point, you are ready for legal services from our firm.

The language above is not magical. Simply, these are the words you testify to at trial. It only takes one spouse to testify.

2. Don't try to work out your property issues. If your spouse and you could get along, you wouldn't be getting a divorce. Since you're getting a divorce, you will not be able to intelligently, calmly, and with finality agree to a disposition of your assets. It's an exercise in futility.

3. You or your spouse comes home late at night. Harsh words are spoken. A body hits the wall. The police come. Fingers point. How do you avoid this situation?

One suggestion is to carry a dictaphone and a camera. One for each hand. Both instruments put the spouse on notice of your intention to record the other's activities.

4. Your spouse angrily states there is no alternative but to divorce. You have many valuables in your house. Photograph all important valuables. Better yet, video tape your house offering verbal descriptions of each valuable.

Later, when the valuable is missing and your spouse innocently states the item was given away two years prior to the divorce filing, you have the evidence to impeach.
